Increasing Corporate Resistance to Donald Trump – 99 Companies File Legal Brief Against Trump’s Immigration Ban

On Sunday evening, 97 tech companies, including Apple, Google and Microsoft, filed an amicus brief to the 9th Circuit Court of Appeals opposing Trump’s controversial executive order restricting travel from seven Muslim-majority countries. Tesla Inc. and SpaceX were among 31 companies added to the brief late Monday afternoon.

The amicus brief notes the crucial and often outsized role that immigrants play in US businesses. The brief also notes how the order will have a negative impact on U.S. business: “The Order effects a sudden shift in the rules governing entry into the United States, and is inflicting substantial harm on U.S. companies. It hinders the ability of American companies to attract great talent; increases costs imposed on business; makes it more difficult for American firms to compete in the international marketplace; and gives global enterprises a new, significant incentive to build operations—and hire new employees—outside the United States.”

The brief goes on to argue that the executive order is unlawful because it “discriminates on the basis of nationality” (which is illegal under the 1965 Immigration and Nationality Act) and because it “exercises discretion arbitrarily.”

This filing is the latest in an ongoing legal battle which will likely end up at the Supreme Court. On January 30th, the states of Washington and Minnesota filed suit against Trump’s executive order. This amicus brief supports the lawsuit by the states of Washington and Minnesota. Amazon and Expedia had already filed separate briefs in support of the states’ case. On February 3rd, US District Judge James Robart issued a temporary restraining order blocking Trump’s executive order nationwide, on the basis that the plaintiffs have a substantial likelihood of prevailing on their challenge to the legality of the executive order. The US Justice Department filed an appeal and on February 5th, the 9th Circuit Court of Appeals denied the US government’s emergency appeal, and asked for both sides to file legal briefs before it makes its final decision.
